1. Introduction

Welcome to iWhost Pakistan (“Company”, “we”, “our”, “us”). By using our web hosting services, you (“Customer”, “you”, “your”) agree to be bound by these Terms of Service (“ToS”). If you do not agree with these terms, please do not use our services.

2. Acceptable Use Policy (AUP)

You agree not to misuse our services. Prohibited activities include but are not limited to:

• Hosting illegal content, including copyrighted material without permission.
• Engaging in phishing, hacking, or malware distribution.
• Sending spam emails or mass unsolicited communications.
• Violating any applicable laws or regulations.
• Using excessive server resources that may impact other users.

Violation of this policy may result in immediate suspension or termination of your account without a refund.

3. Payment & Billing

• All payments must be made in advance.
• Late payments may result in account suspension or termination.
• No refunds are issued for violations of these Terms of Service.
• Customers are responsible for keeping their billing information up to date.

4. Service Level Agreement (SLA)

• We strive for 99.9% uptime but do not guarantee uninterrupted service.
• Downtime caused by maintenance, third-party failures, or unforeseen issues does not qualify for compensation.

5. Limitation of Liability

• We are not responsible for any data loss, security breaches, or business interruptions caused by service failure.
• The maximum liability of the company shall not exceed the amount paid by the customer in the last 7 days.

• iWhost Pakistan holds no liability for service discontinuation due to unforeseen circumstances, including but not limited to bankruptcy, force majeure, or the owner’s incapacity.

6. Disclaimer of Warranties

• Our services are provided on an “as is” and “as available” basis without warranties of any kind.
• We do not guarantee that our services will be uninterrupted, error-free, or completely secure.

7. Termination Policy

• We reserve the right to suspend or terminate any account without prior notice if found violating our ToS.
• Customers may request account cancellation at any time.
• No refunds will be issued for early termination by the customer.

8. Data Protection & Privacy

• We respect your privacy and comply with applicable data protection laws.
• We do not sell or share your personal data with third parties except as required by law.
• Customers are responsible for maintaining their own backups. We are not liable for lost data.

9. Indemnification

You agree to defend, indemnify, and hold harmless iWhost Pakistan from any claims, damages, losses, or expenses arising from your use of our services.

10. Modifications to Terms

• We reserve the right to update these Terms of Service at any time.
• Continued use of our services after any modifications constitutes acceptance of the revised terms.

11. Governing Law & Dispute Resolution

• In case of any dispute, parties will resolve the matter through discussion. If disputes cannot be resolved through discussion, it may be referred to a neutral arbitrator.
• Neither party shall take legal action against the other in any court of law.
• If a resolution cannot be reached, the services may be terminated, and any amount paid by the customer in the last 7 days will be refunded.

12. Entire Agreement & No Separate Contracts

• These Terms of Service constitute the entire agreement between iWhost Pakistan and the customer.
• No separate Memorandum of Understanding (MoU) or individual agreements will be signed with any party.
• Any verbal or written negotiations outside of these Terms are not legally binding.
